TattWise Terms of Use

These Terms of Use form a binding agreement between you and TattWise when you create an account, browse listings, post a tattoo project, submit a bid, request an available design, or otherwise use TattWise. If you do not agree, do not use the service.

1. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract. You must provide accurate information, keep your account secure, and use only one account for each role unless TattWise approves otherwise. You may not evade a suspension, review history, bid limit, or other safety control by creating another account.

2. Marketplace role

TattWise is a technology marketplace connecting customers, tattoo artists, and studios. TattWise does not perform tattoos, employ listed artists, guarantee licensing or workmanship, provide medical advice, or supervise appointments. Users are responsible for evaluating each other, confirming licensing and insurance, discussing health concerns, and deciding whether to proceed.

3. Projects, bids, and available designs

Customers must describe projects honestly and may not materially misrepresent size, placement, references, timing, or budget. Artist bids are good-faith estimates based on the posted information, not guaranteed final prices. An artist may maintain only one bid per project. Automated bidding, bid manipulation, collusion, false identities, and attempts to bypass platform limits are prohibited. Available designs remain the artist's intellectual property unless the artist expressly agrees otherwise.

4. Artist and studio responsibilities

Artists and studios are solely responsible for maintaining all licenses, registrations, sanitation practices, insurance, permissions, and professional standards required where they work. Verification indicators reflect information reviewed by TattWise and are not a warranty. Public business contact information must be accurate.

5. Communications and privacy

Before a match, customers are identified by their screen names. Private customer details are disclosed only as described in the Privacy Policy. You may not scrape, harvest, sell, expose, or misuse another person's information. Transactional emails may be sent for important marketplace activity. Marketing emails can be unsubscribed from at any time.

6. Reviews and reputation

Reviews may be submitted only for eligible TattWise matches. Reviews must be truthful, relevant, and based on firsthand experience. You may not buy, trade, fabricate, coerce, or retaliate over reviews. TattWise may use weighted rating methods, delay review publication, remove policy-violating content, and retain account history after closure to protect marketplace integrity.

7. User content and license

You retain ownership of content you submit. You grant TattWise a worldwide, nonexclusive, royalty-free license to host, reproduce, resize, display, distribute, and use that content as necessary to operate, secure, and promote the service. You promise that you have the rights needed to submit it and that it does not infringe another person's rights.

8. Prohibited conduct

You may not threaten or harass others; discriminate unlawfully; post illegal, deceptive, sexually exploitative, or infringing material; distribute malware; scrape or reverse engineer the service; interfere with security; manipulate rankings; spam users; or use TattWise for fraud, trafficking, money laundering, or any unlawful purpose.

9. Cancellations, discipline, and termination

Users may cancel when permitted by the service and may be required to give a reason. TattWise may track cancellations, missed appointments, response patterns, complaints, and rule violations. TattWise may warn, restrict, suspend, or permanently ban accounts, remove content, or preserve records when reasonably necessary for safety, legal compliance, dispute prevention, or enforcement.

10. Disclaimers

TattWise is provided “as is” and “as available.” To the fullest extent allowed by law, TattWise disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, uninterrupted availability, and the quality, safety, price, legality, or outcome of any tattoo service.

11. Limitation of liability

To the fullest extent allowed by law, TattWise and its owners, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal injury caused by a listed provider, or disputes between users. TattWise's total liability for claims relating to the service will not exceed the greater of $100 or the amount you paid TattWise during the preceding twelve months. Some jurisdictions do not allow certain exclusions, so they may not apply to you.

12. Indemnity

You agree to defend, indemnify, and hold TattWise harmless from claims, losses, and reasonable legal fees arising from your content, services, conduct, violation of these Terms, or infringement of another person's rights.

13. Disputes and Minnesota law

These Terms are governed by Minnesota law, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes must be brought in the state or federal courts serving Minnesota, and each party consents to those courts. Nothing here prevents either party from seeking urgent injunctive relief.

14. Changes and contact

TattWise may update these Terms prospectively. Material changes will be announced through the service or by email, and continued use after the effective date constitutes acceptance where permitted by law. Questions may be sent to support@tattwise.com.
